Terms of Service

The following content may be updated, modified or revised at any time without notification.

Client Onboarding

Whether you work with us for a few minutes one time, hourly, or through a monthly retainer we require that all clients digitally sign a contract stating the basic terms of our engagement.

This will be sent via email to an address provided to a tech support agent before work begins.

We do this to protect ourselves, as well as you.

Security Protocol

We encrypt form submissions on our website.

If you submit any type of form, regardless of content, we cannot guarantee that this information will not be open to interception by a third party.

You agree to indemnify, save and hold harmless Docherty, LLC., and its members, affiliates, representatives, contractors, and employees from any and all damages, liabilities, costs, losses or expenses arising out of any claim, demand, or action by a third party arising out of any breach of Client's responsibilities or obligations, representations or warranties under this agreement.

Intellectual Property

Docherty, LLC., as well as its members, affiliates, representatives, contractors, and employees are granting a limited, temporary license to creative and technical design and development services. Before, during, and after engagement it is understood by the client that any content created, modified, removed, altered, changed or otherwise accessed by any party expressly and directly identified within this terms of service document will be fully and completely released of any and all copyrights written or expressed through the use of our visual, creative, or technical services that our company provides to the client.

Indemnification/Liability

By utilizing the services of Docherty, LLC., and its members, affiliates, representatives, contractors, and employees you agree to grant full legal and moral immunity to any damages, financial, punitive, or otherwise. You understand that there are risks when you engage with any company that attempts to modify, repair, fix, troubleshoot, diagnose, or otherwise interact with files, content, or media that reside on your websites server.

Client agrees to indemnify, save and hold harmless Docherty, LLC., and its members, affiliates, representatives, contractors, and employees from any and all damages, liabilities, costs, losses or expenses arising out of any claim, demand, or action by a third party arising out of any breach of Client's responsibilities or obligations, representations or warranties under this agreement.

Non Disclosure Agreement Policy

On request, we will electronically/digitally sign an NDA (non disclouse agreement) between our company and your company. This will be governed by the terms within that particular NDA document.

Service Warranty

On occasion, at the sole discretion of management, if a client spends over $99 with us during a single engagement, we will offer a client a period between 30-90 days of completion of engagement for additional help consisting of a single hour to be utilized in a screen sharing session. There is no guarantee that the issue can or will be resolved within that additional hour of time. If a sales or support agent states otherwise, we are not responsible, nor will we honor any promises made through any exchange of dialog.

Term and Termination

Single-use Services expire once the session with the support representative terminates. For subscription-based Services, this Agreement shall be effective from the date of registration and will automatically renew at the end of the originally purchased plan's billing cycle. In addition, WebsiteTroubleshooting.com may cancel the Services at any time WebsiteTroubleshooting.com, in its discretion, determines that Client's use of the Services is excessive, inconsistent with the scope of the Services, abusive, or inappropriate.

Non-Compete Agreement Policy

We will not sign a non-compete agreement. We believe that trust is important outside of contracts.

White Label Policy

We do not offer white-label services for our work. Your client(s), affiliates, partners, management, or other third party companies or organizations will be aware that our team is performing the work. On a case-by-case basis we will make exceptions, pending management approval.

Backup Policy

Upon explicit request of a client we will initiate, and retain a backup of all files and related databases that we are modifying for a period of 30 days. There is no guarantee that we will have access to the backup or archived content within, or outside of the 30 day time frame. It is a clients sole responsibility to ensure that a backup is made and properly and securely stored within their hosting account or personal means of storage.

Services Provided

We update, design, modify, repair, fix, and troubleshoot website issues not limited to visual modifications, server management, custom development, content migration, and other website development related services.

Refund Policy

We offer refunds for "per issue" engagements only. If you choose to pay a flat-rate or hourly, this time in non-refundable.

If you are not satisfied with the service provided within a period of 30 days from the completion of our engagement, you may request a maximum of one hour of additional time to be utilized in the form of a screen sharing session.

This is not a guarantee of availability or a promise to honor the request. Decisions are made solely within our management team if additional services are warranted.

Hourly, Monthly, Quarterly, or Annual Retainer Agreements

Each engagement is considered a seperate agreement to be governed by a service contract to be distributed at time of engagement before engagement begins. These terms will extend to each service contract unless otherwised mentioned in a particular contract.

Payment and Collections Policy

Any and all payments are due in full, up-front, at time of service before work begins. On occasion we will extend a 24 hour, or 30 day period for payment, under the sole discretion of the management, in writing, before work begins. All payments are to be paid via Stripe, or PayPal using a debit or credit card. You do not have to have an account at PayPal to make a debit or credit card payment. If an employee requests payment, please let us know. We will never ask for payment details over the phone. You will receive an invoice with our branding, tax id, and summary/itemization of services to be performed.

If any and all required payments are not made within a 30 day window of completion of engagement, we will send your account to collections. If you pay up-front, or on-time you have nothing to worry about.

Exhibit A.

By filling out any forms or placing a phone call to WebsiteTroubleshooting.com, as well as emailing our support or any other email address, or even initiating us in a live chat you agree to be added to our mailing list. You will receive periodioc emails that may be promotional or sales oriented. You information will not be shared nor sold to any third party and only used internally within our system for communication purposes and promotions, sales, marketing, etc. This is irrevocable, within reason.
